Terms of Service

Last Updated: September 2026By commissioning Merwytch (“the Artist”), you (“the Client”) confirm that you have read, understood, and agreed to the following Terms of Service. These terms apply unless the Artist and Client agree otherwise in writing before the commission begins.1. PaymentAll prices and payments are in USD and are processed through Square. The Artist will provide the Client with an invoice by email. Please do not send payment through any other method unless specifically arranged with the Artist.A 75% initial payment is required to secure your commission slot. The remaining 25% is due upon completion and before delivery of the final, high-resolution artwork.The initial payment must be received within 48 hours of invoicing unless otherwise agreed. If payment is not received within that period, the Artist may cancel the commission and release the reserved slot.Work will not begin until the required initial payment has been received.2. Turnaround & Commission QueuePlease allow up to four (4) months for completion unless a different deadline has been agreed upon in writing.Commissions will generally be completed in the order in which they enter the Artist’s active queue. Completion times may vary depending on complexity, workload, health, personal circumstances, and other reasonable delays.The Client is welcome to respectfully request an update on their commission.If the Artist becomes unable to complete the commission, the Client will receive a refund for the portion of the commissioned work that has not been completed, up to and including a full refund where appropriate.A guaranteed deadline is not included unless specifically agreed upon before payment. Rush or deadline-sensitive commissions may incur an additional fee.3. Cancellations & RefundsIf the Client wishes to cancel before work has begun, they should contact the Artist as soon as possible. Any applicable refund will be processed according to the amount of work already performed and any non-recoverable costs or fees, where permitted by law.Once work has begun, refunds are generally unavailable except where required by law or where the Artist is unable to complete the commission.The Client may request a different character before work begins. If the replacement character or design is more complex than the original request, the Artist may issue an additional invoice for the difference in price.Failure to respond to necessary questions or approvals for an extended period may delay the commission.4. Revisions & Reference MaterialsThe Client is responsible for providing accurate and reasonably clear references before work begins.If important visual information is not supplied, the Artist may exercise reasonable artistic interpretation.Highly intricate patterns, armor, jewelry, tattoos, props, or other complex elements may incur an additional fee. Where insufficient reference material is provided, the Artist may simplify or omit exceptionally intricate details after discussing the issue with the Client.Requests that substantially alter an already-approved design, pose, composition, character, outfit, or other major element may incur an additional revision fee.Errors made by the Artist that contradict clearly provided and previously agreed-upon references will be corrected without an additional charge.5. Backgrounds & Additional ElementsStandard commission pricing includes simple or decorative backgrounds, such as colors, gradients, patterns, textures, or other modest decorative elements appropriate to the artwork.Complex environments are not ordinarily included unless specifically offered or agreed upon.Additional hand-drawn or rendered elements—including elaborate props, scenery, creatures, weapons, magical effects, or other complex objects—may incur an additional fee.Please ask before ordering if you are uncertain whether a requested element falls within the standard commission price.6. Artistic StyleBy commissioning Merwytch, the Client acknowledges that they are commissioning artwork in the Artist’s current style.The Artist’s work and techniques naturally evolve over time. Consequently, the final artwork may contain reasonable stylistic differences from older portfolio examples.The Artist retains reasonable creative discretion regarding rendering, brushwork, lighting, color, composition, and other stylistic decisions unless specific requirements have been agreed upon beforehand.7. Copyright & OwnershipUnless a separate written agreement expressly states otherwise, the Artist retains all copyright and intellectual-property rights in the commissioned artwork itself.Payment for a standard commission does not constitute a transfer or sale of copyright.Once full payment has been received, the Client receives the final high-resolution digital file and a non-exclusive, non-transferable license for personal use as described below.The Client may not:
• Claim authorship of the artwork;
• Represent the artwork as having been created by someone other than Merwytch;
• Sell, sublicense, redistribute, or commercially exploit the artwork
• Remove or deliberately obscure an Artist signature or watermark where one has been included
• Grant another person or business rights to use the artwork beyond the Client’s permitted personal useWhere reasonably possible, credit when publicly sharing the artwork is greatly appreciated and should identify the Artist as Merwytch.Ownership of a character belonging to the Client is not transferred to the Artist merely because the Artist has illustrated that character. Likewise, commissioning artwork of a character does not transfer the Artist’s copyright in the resulting illustration to the Client.8. Personal & Commercial UseUnless otherwise agreed in writing, commissions are licensed for personal, non-commercial use only.
Examples of permitted personal use include:
• Personal avatars and profile pictures
• Personal wallpapers and device backgrounds
• Posting the artwork to personal, non-commercial social media or character-profile pages
• Printing a copy for the Client’s own personal display
• Using the artwork privately for a tabletop roleplaying character or campaignThe Client may not sell prints, merchandise, digital products, or other reproductions containing the artwork.Commercial use includes use intended to generate revenue, advertise or promote a business, solicit customers, support a commercial brand, appear in monetized products, or otherwise contribute directly or indirectly to financial gain.
Commercial uses may include, but are not limited to:
• Merchandise
• Books or published games
• Business branding
• Advertising and marketing
• Monetized streaming or video branding
• Promotional assets
• Products offered for saleCommercial licensing may be available for an additional fee and must be agreed upon in writing before commercial use begins.9. Artificial Intelligence / Machine LearningThe Artist expressly prohibits the use of any original or commissioned Merwytch artwork for generative artificial intelligence, machine learning, or similar automated content-generation technologies.The Client may not knowingly:
• Upload or submit the artwork to an AI image generator;
• Use the artwork as an image prompt, image-to-image input, style reference, or similar generative input
• Use the artwork to train, fine-tune, retrain, develop, evaluate, or improve an AI or machine-learning model
• Include the artwork in a training, reference, benchmarking, or machine-learning dataset
• Create or distribute datasets containing the artwork for AI/ML purposes
• Use the artwork to create a model, LoRA, embedding, checkpoint, style model, or other system intended to reproduce or imitate the artwork or
Artist’s style
• Authorize another person or organization to use the artwork for any of the purposes aboveNo AI or machine-learning rights are granted by purchasing a commission.These restrictions apply to commissioned artwork as well as other artwork created by Merwytch unless the Artist expressly provides written permission otherwise.10. Cryptocurrency, NFTs & Blockchain UseArtwork created by Merwytch may not be minted, tokenized, sold, traded, advertised, or otherwise used in connection with:
• NFTs
• Cryptocurrency
• Blockchain-based assets
• Tokenized artwork
• Similar speculative digital-asset systemsNo NFT, cryptocurrency, or blockchain rights are granted with a commission.11. Artist’s Portfolio & Promotional RightsUnless privacy arrangements are made beforehand, the Artist retains the right to display commissioned artwork for reasonable self-promotional and portfolio purposes, including:
• Social media
• Commission examples
• Portfolio work
• Convention or promotional displays
• Process demonstrations
• Timelapses/speedpaintsThe Artist will not claim ownership of a Client’s original character merely by displaying the commissioned illustration.If the Client requires the commission to remain private, confidential, embargoed until a particular date, or permanently excluded from the Artist’s portfolio/social media, this must be discussed before payment.
Private commissions may incur an additional fee.12. Mature & Graphic ContentThe Artist does not accept explicit sexual/NSFW commissions or extreme graphic content.This includes, at the Artist’s discretion:
• Explicit sexual activity
• Fetish/kink-focused artwork
• Pornographic scenarios
• Extreme gore or graphic violenceSuggestive themes, non-explicit sensuality, artistic nudity, mild-to-moderate blood, or similar mature content may be accepted solely at the Artist’s discretion.The Artist reserves the right to decline any subject matter that causes discomfort or falls outside the Artist’s desired portfolio.13. Right to Refuse ServiceThe Artist reserves the right to decline a commission request before entering into an agreement for any lawful reason, including requests that fall outside the Artist’s skills, availability, boundaries, or desired subject matter.If circumstances arise after acceptance that make completion impossible or inappropriate, the Artist will communicate with the Client and handle any refund owed in accordance with these Terms and applicable law.14. Digital DeliveryCommissions are digital products only unless explicitly stated otherwise.No physical print, canvas, or other product will be mailed to the Client.
The final high-resolution file will be delivered after the remaining balance has been paid in full.15. File StorageThe Client is responsible for downloading and safely backing up their completed commission.
Clients should download their final files within thirty (30) days of delivery.The Artist does not guarantee permanent archival storage of completed commissions and may periodically delete old working and final files, including during annual file maintenance.Once artwork has been successfully delivered, loss of the Client’s personal copy does not entitle the Client to a refund.If the Client is unable to download or safely store the files after delivery, they should contact the Artist as soon as possible so that an alternative arrangement can be discussed.16. Acceptance of TermsSubmitting payment toward a Merwytch commission signifies that the Client has read, understood, and agreed to these Terms of Service.Any modification to these Terms for a particular commission must be agreed upon in writing by both the Artist and Client.These Terms do not limit any rights or remedies that cannot lawfully be waived under applicable law.Questions before commissioning?*Please ask away! Working Process Information

• The Client will receive a draft sketch for approval. Afterward, a cleaner sketch will be provided for second approval. Please list all the desired changes when receiving these drafts. If everything is approved, I will proceed to finish the artwork and send a final copy.• Please also keep aware that I offer a limited amount of edits during the sketching phase. Be upfront with any changes you need but keep in mind that there’s a limit to how many times I allow edits. If something isn’t a necessary detail/change, please don’t list it after the first draft sketch.• After the second draft has been approved and/or the color process has begun, I will not make any further adjustments to the lineart or sketch.• If you want to change anything in the finished piece that wasn’t mentioned beforehand, there will be a fee depending on the changes.• When the commission is complete, you will receive a high quality file of the finished commission, as well as one with my watermark. I am also happy to send over high quality sketch files upon completion should you desire them.
